Thank you for using Travelyn!
Travelyn” or “Company”). These Terms of Use (“TOU”) apply to services provided through the [travelyn.com] site and through its mobile version (the “Website”).
These TOU represent a binding contract between you and the Company, and by creating an account or otherwise accessing the services offered through the Website, you expressly agree to be bound by them. If you do not agree to be bound by the TOU, you may not use or purchase any of the services offered thorough the Website.
The Website is used to:
- provide you with information about our business and services;
- provide services in the form of flight search engine and a ticket booking tool;
- enable creation of an account to facilitate management of your bookings (the “User Account”)
- enable conclusion of contract with airlines;
- facilitate communication between you and Travelyn;
- process your payments for our services;
- subscribe to our newsletter, price or flight alerts, as may be applicable,
collectively to be referred to as the “Services”.
By using our services and/or accepting these TOS, you confirm that you are of 18 years of age or older and have a full legal capacity to enter into a binding agreement with us.
The minimum technical requirements to use the Website and our Services are as follows:
- Internet connection;
- the most up to date version of one of the following browsers with enabled cookies and JavaScript: Microsoft Edge, Mozilla Firefox, Opera, Google Chrome, Apple Safari.
The Website uses cookies and similar technologies. Enabling cookies will help you make the most of your experience using the Website. For more information on cookies, please refer to our Privacy and Cookie Policy.
Through the Website you are able to link to other websites which are not under the control ofTravelyn. We have no control over the nature, content and availability of those sites and to the maximum extent permitted by applicable law Travelyn assumes no responsibility for your use of such third-party websites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.
In order to search for flights, you should fill in the departure point, destination and desired dates of flights. You can use our services both as a guest and through a User Account created on our Website.
Once you have received search results, in order to book the ticket, you will be required to provide additional data, as may be required by the carrier, including but not limited to the passenger’s name and surname, e-mail address, phone number, luggage selection, and (where the invoice option has been selected) the details required for invoicing.
The provided data is subsequently submitted to the airline/airlines upon clicking of a confirmation button. At the same time, the submission of data shall be construed as your offer to conclude a booking service provision contract with Travelyn (the “Intermediary Contract”).
As a next step, Travelyn verifies authenticity of your credit or debit card. In case of negative verification, Travelyn may contact you and ask for additional verification of your identity or may ask you to provide details of another card/means of payment.
Upon positive verification of your payment method, Travelyn confirms availability of the seat on the route and the price selected by you. This secondary verification is required due to the fact that the process of real-time ticket sale by airlines is conducted through various channels that are outside Travelyn’s control. This means that the initially selected seats may no longer be available at the price quoted.
If the above-mentioned verification of the availability of seats and prices is positive, you will receive the confirmation reference number and your tickets at the e-mail address provided at checkout, which means that you concluded a contract with the airline(s). The e-mail confirmation shall at the same time be construed as Travelyn’s acceptance of your offer to conclude an Intermediary Contract.
In case of negative verification of price and seats availability, you will receive a notification at the e-mail address provided upon registration and/or checkout. This means that no contractual relationship was concluded between you and the airline(s) and no additional contract between you and Travelyn was concluded for the booking service. In the event that any payments were made to Travelyn for the booking service, and the user has not selected alternative tickets, the payments will be refunded within 14 days.
Apart from the carriage fee due to the airline, Travelyn will charge the user with the service fee pursuant to the Intermediary Contract (the “Service Fee”). The exact amount of the Service Fee will each time be displayed at the point of payment, as a subset of the full price payable by you the “Full Price”). The Full Price will include the Service Fee, as well as all the charges requested by the carrier, such as: the airline carriage fees, luggage fees and other charges, taxes and duties as may apply.
Through Travelyn you can purchase single tickets, as well as multiple tickets which form a combination of flights found via the Travelyn booking system. The multiple tickets purchased shall be referred to as the “Trip”.
You are only authorised to view, copy, print, and distribute (but not modify) the content on the Website, provided that such use is only for noncommercial purposes.
Some features of our Services may either now or in the future allow you to post or submit content and materials for publication as part of our Services (“Your Content”). You assert that you own any intellectual property rights to Your Content, but you agree that we can use, reproduce, modify, adapt and publish Your Content for purposes of enabling us to offer the Services or the features you have elected to use. You are responsible for Your Content, and acknowledge that once published, we cannot always remove it.
We are providing you with access to Services pursuant to a limited, non-exclusive, non-sublicensable, non-transferable, revocable license. You can use our Services for personal, non-commercial use only, and subject to the TOS. This license is available to you as long as you are not barred from Services by applicable law and your account is not terminated by us or by you. If the TOU are not enforceable where you are located, you may not use the Services. The company reserves all right, title, and interest not expressly granted under this license to the fullest extent possible under applicable laws.
Travelyn offers a Guarantee in case that one of the connections which are part of your Trip is cancelled, delayed or rescheduled, resulting in your failure to make a planned transfer or reach your destination (the “Guarantee”).
The Travelyn Guarantee applies provided that:
- the booking was marked as covered by Travelyn Guarantee at the point of checkout;
- you purchased a Trip – the Travelyn Guarantee shall not apply to single tickets purchased through Travelyn booking system;
- the cancellation, rescheduling or delay resulted in your inability to use at least one ticket covered by the Trip and reach your destination;
- you contact Travelyn immediately, not later than (i) 12 hours from the time you received information about cancellation, delay or rescheduling: if you learn about the event more than 48 hours prior to the planned departure; or (ii) 1 hour from the time you received information about cancelation, delay or rescheduling: if you learn about the event 48 hours or less prior to the planned departure;
- Travelyn is notified either through the Call Center or at the following e-mail address: support@travelyn.com,
The Travelyn Guarantee shall not apply if:
- you fail to make the connection due to reasons attributable to you (such as failure to arrive at the airport on time, refusal by the carrier to admit you to the flight for breach of carrier’s policies or applicable law; loss of luggage at the airport which is not attributable to Travelyn and prevents you from taking any of the flights covered by your Trip; failure to obtain a required visa);
- you make changes to your Trip outside of Travelyn’s booking system;
- the Force Majeure exclusion defined below applies.
In order to take advantage of the Travelyn Guarantee, you should notify Travelyn about the cancellation, delay or rescheduling no later than within 12 hours from the moment you learned about the change to your Trip schedule. Notifications are accepted 24 hours a day, 7 days a week, only via the dedicated phone number +46 200 883 998 or via e-mail, at support@travelyn.com.
Travelyn will take steps to answer your request within reasonable time, in any case no later than within 24 hours of your correctly made notification.
Travelyn will decide, taking into account all the available options and circumstances at hand, which of the following Travelyn Guarantee cover options to offer you:
- find for you and cover the reasonable costs of alternative flights for unused flights which formed part of your Trip; or
- refund the price of the unused tickets, if no alternative flight option at a reasonable cost is available.
The Travelyn Guarantee applies only insofar as you are unable to make the full Trip due to cancellation, delay or rescheduling.
In the event that at least one of the tickets within your trip is cancelled, delayed or rescheduled 48 hours or less prior to the planned departure, which results in your inability to make the full Trip, you are entitled to choose the preferred Travelyn Guarantee cover option, out of the following:
- find for you and cover the reasonable costs of alternative flights for unused flights which formed part of your Trip; or
- refund the price of the unused tickets, if no alternative is possible.
If the price difference between the original flight and the new flight option found by us (to replace the flight(s) you were unable to use due to delay, rescheduling or cancellation) is disproportionately high (exceeding 50% of original flight price), Travelyn can offer proportionate contribution, agreed with you individually on a case by case basis.
In order to take advantage of the Travelyn Guarantee, you should notify Travelyn about the cancellation, delay or rescheduling no later than within 1 hour from the moment you learned about the change to your Trip schedule. Notifications are accepted 24 hours a day, 7 days a week, only via the dedicated phone number +46 200 883 998 or via e-mail, at support@travelyn.com.
Travelyn will take steps to answer your request within reasonable time, in any case no later than within 24 hours of your correctly made notification.
a) Accommodation
Provided that the Travelyn Guarantee applies pursuant to provisions of Sections 4 – 4.2 above, Travelyn will reimburse you for the costs of one overnight accommodation up to the value of EUR 50 per person. The following conditions must be met (cumulatively):
- at least one of the flights within the Trip is rescheduled, delayed or cancelled, which results in your inability to successfully complete the Trip;
- stopover at the airport is longer than 8 hours;
- stopover partly or entirely takes place between 11pm - 6am.
b) Meals and beverages
Provided that the Travelyn Guarantee applies pursuant to provisions of Sections 4 – 4.2 above, Travelyn will reimburse you for the costs of meals and beverages up to the value of EUR 10 per person. The following conditions must be met (cumulatively):
- at least one of the flights within the Trip is rescheduled, delayed or cancelled, which results in your inability to successfully complete the Trip;
- stopover at the airport is longer than 4 hours.
c) Exclusions
The Travelyn Guarantee shall not cover:
- the option to buy alternative flights on their own in case that you are unable to contact Travelyn;
- making any other individual purchases (all alternative flights shall be booked via the Travelyn Call Center);
- refunds for transportation, such as taxi fares to an alternative airport, etc.)
The Travelyn Guarantee shall not apply to cases of flight delays, change or cancellation caused by extraordinary circumstances which could not have been avoided even if all reasonable measures had been taken ("Force Majeure"). Such circumstances may, in particular, occur in cases of political instability, meteorological conditions incompatible with the operation of the flight concerned, security risks, unexpected transport safety shortcomings and strikes that affect the operation of an operating air carrier, significant limitation of airport(s), bus and train station(s) and/or other transition places operation, as well as bankruptcy, and/or insolvency or termination of 50% or more of all flights of the Selected Carrier or any other effect which significantly limits or disables the selected or operating Carrier to provide its services (hereinafter referred as "Force Majeure").
In order to make use of the Travelyn Guarantee, you hereby agree to assign to Travelyn your rights and claims arising in connection with the provision of Our Services based on Regulation (EC) No. 261/2004 of the European Parliament and of the Council of 11 February 2004 establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or a long delay of flights, and repealing Regulation (EEC) No. 295/91.
You agree to provide Travelyn, or our authorised subcontractors, with all reasonably required assistance in order to enforce the Claims, including by provision of appropriate documentation, as may reasonably be required (in particular by sending us authorisation or the power of attorney to represent you vis-a-vis the carrier).
If the amount of the enforced claim exceeds Travelyn’s expenses from the Guarantee, the remainder shall be transferred back to you.
You hereby acknowledge and agree that as a consumer you are not entitled to withdraw from the Intermediary Contract, i.e. you agree to lose your right to withdrawal once the contract has been fully performed by us (once the intermediation service is performed and the airline tickets are booked) and you expressly agree that we begin the performance of the contract before the lapse of the 14 days’ withdrawal period.
You thereby acknowledge that you lose your right of withdrawal.
As regards withdrawal from the respective carriage agreements with airlines, you hereby acknowledge that these are governed by the carrier’s terms & conditions. For information about the availability of refunds, please review Section 6 below.
You can also delete your User Account by contacting Travelyn at support@travelyn.com.
If you are not satisfied with our Services or in case you encounter any problems, you can file a complaint in an electronic form by contacting our Customer Service team at support@travelyn.com. Your complaint will be examined as soon as possible, in any case no later than within 30 days of the date on which the Company received your complaint. Your complaint should include the description of the issue you encountered and the preferred solution to your problem. Our response to your complaint will be sent to the e-mail address from which the complaint was sent or to any e-mail address indicated by you.
By providing payment information to us, you agree that the payment information is valid and (1) in your name or (2) in the name of an individual who has authorised you to use their payment information.
If you provide someone else’s payment information, you agree that we may refund payment to that person if they so request and if the account is eligible for a refund.
We expect, that our users do not misuse our products and services. You shall not:
- Attempt to impersonate another person or use another person’s account information without authorisation;
- Use or distribute Services for your own scientific or clinical research purposes;
- Violate or attempt to violate Services’ security features, including logging into a server that you are not authorised to access, or probing the vulnerability of Services' systems and networks;
- Redistribute, decompile, reverse engineer, publish, or copy Services;
- Use Services for the purpose of creating a product with a substantially similar look, feel or design;
- Access or search Services by any means other than our publicly supported interfaces (for example, “scraping”);
- Use Services or any trademarks, game names, trade names, service marks, copyrights, or logos of the Company, in unsolicited mailings, spam material, contests or surveys, or to create the impression that such items are associated with you;
- Violate any third party’s rights, including intellectual property or privacy rights;
- Threaten, stalk, harm, or harass others; or engage in activity in connection with the Services that is fraudulent, abusive, defamatory, illegal or otherwise inappropriate or upload illegal or defamatory content through the use of Website or our services.
Engaging in prohibited uses gives ground for immediate termination of your account and may also expose you to civil or criminal liability.
You agree that we may send communications to your email address for customer service, confirmations, newsletters, product offers and other matters.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT THE USE OF SERVICES IS AT YOUR OWN SOLE RISK AND THAT SERVICES ARE PROVIDED ON AN “AS IS”, “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY AND ITS AFFILIATES, OFFICERS AND/OR EMPLOYEES EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. Some jurisdictions do not allow the disclaimers in this paragraph, so they may not apply to you.
THE COMPANY STRIVES TO MAINTAIN SERVICES ON A COMMERCIALLY REASONABLE BASIS AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW CANNOT GUARANTEE THAT YOU WILL HAVE ACCESS TO SERVICES AT ALL TIMES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COMPANY OR ITS AFFILIATES, OFFICERS AND/OR EMPLOYEES BE LIABLE WITH RESPECT TO SERVICES FOR (I) IN THE AGGREGATE, ANY AMOUNT IN EXCESS OF THE FEES PAID BY YOU TO SUBSCRIBE TO SERVICES; (II) LOST PROFITS, LOST DATA, OR FAILURE TO MEET ANY DUTY INCLUDING WITHOUT LIMITATION GOOD FAITH AND REASONABLE CARE ARISING OUT OF YOUR ACCESS TO OR USE OF SERVICES; OR (III) ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER.
YOU AGREE THAT THIS LIMITATION OF LIABILITY REPRESENTS A REASONABLE ALLOCATION OF RISK AND IS A FUNDAMENTAL ELEMENT OF THE BASIS OF THE AGREEMENT BETWEEN COMPANY AND YOU. YOU UNDERSTAND THAT SERVICES WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS. Some jurisdictions do not allow the limitations in this section, so they may not apply to you.
To the maximum extent permitted by applicable law, you will indemnify and hold harmless Travelyn, its affiliates, officers and/or employees, including by paying costs and attorney’s fees, from any claim or demand made by any third party due to or arising out of your access to Services, Your Content, or the violation of the TOS by you.
Severability and Waiver. If any part of the TOS is held invalid or unenforceable, the remaining provisions of the TOS will remain in full effect and an enforceable term will be substituted reflecting yours and our intent as closely as possible. Either party’s failure to enforce any term or condition in the TOS is not a waiver of its right to do so later.
Governing Law. To the extent permitted by applicable law, the TOS shall be governed by the law of the Kingdom of Sweden. The parties shall seek to resolve all the disputes or conflicts which may arise out of or in connection with these TOS amicably. If you are located in the EEA, as a consumer you have the possibility to use the European Commission’s Online Dispute Resolution system available at: https://ec.europa.eu/consumers/odr/main/?event=main.home.show.
Change Policy. The TOS may be updated from time to time for an important reason, e.g. in case we materially change the way we operate or in response to legislative changes. If we make material changes, we will provide advance notice to you either by email, by posting a notification upon logging in onto your account or by posting an updated TOS on the Website at least 30 days in advance of the effective date of the updated TOS. Please note that unless otherwise provided by applicable law, your continued use of Services following the effective date means that you agree with, and consent to be bound by, the updated TOS.
Miscellaneous. The TOS are the complete and exclusive statement of the mutual understanding of the parties and supersede all previous written and oral agreements relating to the subject matter of the TOS. If there is any conflict between the TOS and any additional terms, conditions, and rules posted by the Company on Services, the TOS shall govern, unless otherwise indicated.
